Subject: IMPLEMENTATION OF ORDER OF HON’BLE CAT KOLKATA
BENCH IN OA NO.380/04 FILED BY SHRI SUBHASH
CHANDRA BASU AND 04 OTHERS


In suppression of this Ministry’s letters No.CP(P)/7837/Report/Tele Staff/1838/US(MP)/D(N-II) dated 2nd December 2005 and CP(P)/7837/Report/Tele Staff/145//US(MP)/D(N-II) dated 28th February 2006 on the above subject, I am directed to convey the sanction of the President to the grant of the following pay scales to the Telephone Operators of Indian Navy, as already sanctioned to the Telephone Operators/Civilian Switch Board Operators of Army/AG’s Branch, vide MOD letter No.B/44572/Balaraj/Sigs 4©/92/CC/D(QS) dated 27.02.2004, with effect from 1.1.1996, as under:-

a) Telephone Operator – Grade II Rs.3200-4900
b) Telephone Operator – Grade I Rs.5000-8000
c) Telephone Supervisor Rs.5500-9000
d) After completion of 16 years of Rs.5000-8000
service
e) After completion of 26 years of Rs.5500-9000
service

2. The upgraded pay scales will be applicable with effect from 1.1.1996, in satisfaction of the orders of Hon’ble Central Administrative Tribunal, Kolkata Bench in O.A. No.380/04 passed on 20.07.2005. Consequent to extension of the Time Bound Promotion Scheme, as prevalent in the Army to the Navy’s Telephone Operators, the benefits granted to the Army to the navy’s Telephone Operators, the benefits granted to the Telephone Operators of the Navy under the ACP Scheme introduced vide Govt. of India letter No.35034/1/97-Estt.(D) dated 9th August 1999 will be treated as withdrawn as both the Schemes, i.e. the ACP Scheme and Time Bound Promotion Scheme cannot run concurrently.

3. The issues with the concurrence of Ministry of Defence (Fin) vide their ID No.814/NA/06 dated 22.8.2006.

Subject: Admissibility of Family Pension to the judicially separated spouse under the CCS(PENSION) Rules, 1972.


Summary : With reference to the Deptt of Pension and Pensioners' Welfare OM No.1/6/98-P&PW(E) dated 05/07/1999 regarding eligibility of judicially separated spouse of Government servant for payment of family pension subject to the provision of Rule 54(11-A&B) of the CCS(Pension) rules, 1972 and to say that the President is pleased to decide that the payment of family pension is to be allowed to judicially separated spouse of Armed Forces Personnel after his/her children cease to be eligible for family pension till his/her death or remarriage, whichever is earlier.

This issues with the concurrence of Defence Finance (Pension) vide their U.O No.3202/Pen/2000 dated 28/08/2000.

Subject: Maintenance of Status quo regarding exemption of the total disability pension admissible to the Armed Forces Personnel from IT - reg


Summary :The clarifications regarding exemption from IT of the entire disability pension admissible to the Armed Forces personnel. The matter has been re-examined. The entire disability pension i.e disability element and service element will be exempted from Income-tax. This letter will supersede all earlier clarifications issued on this subject.
